DAMN, Blagojevich is embarrassing! ~ Burris has a decent reputation, but with the state senate impeachment panel chugging forward, ALL Illinois state politicians regardless of party wanting to oust Blago, and Harry Reid threatening to NOT seat any Blago appointment, why would Burris put himself in this position by accepting the appointment? ~ and why would Blago put himself FURTHER into the muck by trying to pull this off? ~ and Bobby Rush rushes in to say blocking Burris would be "racist" ~ the ONLY funny [well, not really funny ~ more like warped] part is that Blago actually said, seriously, that he's been "enjoying the attention" ~ the guy has more than just a few bolts loose ~ Sooz

You have to give him credit for having some guts. He's going down but wants to make it as difficult as possible on as many other people as possible. Fact is, he's the gov and he did what govs do in appointing the guy. Let's see if anyone else has guts enough to stop it.

Maybe Blagojevich hates Burris and this is his way of getting back at the guy for some unknown reason. It puts everyone in a difficult situation

And so the Blago circus continues ~ I didn't know Terry Gainer was the Senate sergeant-at-arms ~ he's got a strong reputation as a good, and very competent, guy ~ and a VERY no-nonsense guy ~ and I read that Fitzgerald has filed a motion asking for an extension of time to bring an indictment against Blago ~ the deadlines were significantly shortened when Fitzgerald arrested Blago withOUT an indictment ~ IF the extension request is denied, the deadline is early next week [I think] ~ and obviously, and apparently still, Fitzgerald must not yet have a strong enough case to get an indictment ~ Image ~ Sooz

(CNN) -- The man tapped by Illinois' embattled governor to fill an open U.S. Senate seat will be turned away if he arrives for Tuesday's inauguration of new members, according to two Democratic aides.

Roland Burris, Illinois Gov. Rod Blagojevich's pick to fill President-elect Barack Obama's vacant Senate seat, will not be allowed on the Senate floor, according to the aides -- one who is familiar with Senate Democratic leaders' plans, and the other an aide to the Senate Democratic leadership.

Democrats in the Senate have twice this week said they have the authority to refuse to accept anyone appointed by Blagojevich, who was arrested December 9, accused by federal authorities of corruption, including allegedly trying to sell Obama's seat for personal gain.

Blagojevich, who denies wrongdoing and has ignored calls to resign, named Burris -- a Democrat and a former Illinois state comptroller and attorney general -- to serve the last two years of Obama's Senate term.

The first Democratic aide said if Burris tries to enter the Senate chamber on Tuesday, the Senate doorkeeper will stop him. If Burris were to persist, either trying to force his way onto the Senate floor or refusing to leave and causing a scene, U.S. Capitol police would stop him, the aide said.

"They [police] probably won't arrest him," but they would call the Senate's sergeant-at-arms, the aide said.

Burris has indicated he intends to be at the Senate on Tuesday. When asked about what would happen if he shows up, Burris told the Chicago Tribune that he is "not going to create a scene in Washington."

"We hope it's negotiated out prior to my going to Washington," he added, according to the Tribune.

Burris told CNN that he was "certainly going to make contacts with the leadership to let them know that the governor of Illinois has made a legal appointment, and that I am currently the junior senator for the state of Illinois."

"And we're hoping and praying that they will see the reason in appointing me as a very qualified, capable, able and ready-to-serve individual," Burris said.

The Senate sergeant-at-arms, Terrance Gainer, served in the Illinois government at the same time as Burris. Gainer was the director of the Illinois State Police from 1991 to 1995 -- the same years Burris was the Illinois attorney general.

Senate Democratic leaders also have discussed what might happen if Blagojevich shows up on Capitol Hill on Tuesday, the first aide said. This would be a "radioactive" situation, according to the aide, because Senate Democratic leaders could not deny Blagojevich entry, as sitting governors have floor privileges in the Senate.

Governors are allowed to walk around the Senate chamber or talk with senators while on the floor, though they cannot vote or formally address the Senate.

Blagojevich's spokesman, Lucio Guerrero, said the governor is aware he is allowed access to the Senate floor, but "the idea of going on Tuesday was first raised by a reporter," not Blagojevich.

The governor is not planning on going to Capitol Hill, Guerrero said.

It seems that Blago didn't actually commit a crime. He just wanted to commit a crime.

What happens to pols in Chicago? Is it something in the water? Too much walleye in their diet or what?

Obviously, Fitzgerald didn't have enough of a case [even after 5 or so years of investigation] to go to the grand jury for a criminal indictment ~ but arresting without a criminal indictment is the first obvious tactical error I've seen Fitzgerald make ~ if nothing else, I think a pretty solid case could be made for conspiracy under RICO laws ~ but conspiracy is a criminal charge ~ and legally a criminal charge is authorized only by a criminal indictment ~ so ... no indictment = no criminal charge ~ I haven't seen whether or not Fitzgerald's motion to extend time has been granted ~ but while Blago is legally still the sitting governor, the feds have retracted his access to "top secret" intelligence, including things like terror threats ~

Blago was the first Dem governor in something like 20+ years ~ and I begrudgingly admit that I voted for him ~ twice ~ Image

I hit "send" to soon ~ I intended to add a comment that wanting, especially when coupled with "testing the waters", to do the crime is fairly corrupt in itself in my book ~

U.S. granted more time to indict Blagojevich


Federal prosecutors have been granted an extra three months to seek an indictment of Gov. Rod Blagojevich.

U.S. Chief District Court Judge James Holderman entered an order allowing the indictment deadline to be extended from Jan. 7 to April 7, according to the court docket in the Blagojevich case. Prosecutors had sought the extension last week, citing the complexity of their investigation of pay-to-play politics in the Blagojevich administration.

The government charged Blagojevich in a criminal complaint, citing the need for speed to keep him from allegedly making a deal to sell his appointment to the U.S. Senate seat vacated by President-elect Barack Obama to the highest bidder. But it must seek a formal indictment because defendants cannot be tried on criminal complaints, which can only initiate a federal criminal case.

In making its case for the time extension, prosecutors had noted that "thousands of phone calls were intercepted between late October 2008 and early December 2008. In addition, multiple witnesses have come forward in recent weeks to discuss their knowledge of criminal activity in relation to the ongoing investigation" of the governor and and John Harris, the governor's former chief of staff.

Also, attorneys in the Blagojevich case are expected in federal court this afternoon as the chief judge weighs another request from the U.S. attorney's office.

Prosecutors also have asked Holderman to allow them to turn over portions of secretly made tape recordings in their probe of the governor to the House special investigative committee looking into impeaching Blagojevich.

Holderman has not signaled whether he will immediately hear arguments on that request or allow prosecutors and lawyers for the government to file written briefs.

U.S. Atty. Patrick Fitzgerald last week asked Holderman to allow him to give state lawmakers edited portions of four secret recordings in which Blagojevich allegedly sought campaign cash for signing legislation helpful to the state's horse-racing industry.

Well, Burris was NOT seated today ~ his paperwork was NOT complete because it lacked the IL Secretary of State signature required ~ and Jesse White, the IL SoS, refuses to sign ~ so Burris is now holding press conferences and threatening lawsuits ~ I saw Dick Durbin interviewed the other day ~ Durbin said that, technically, Blago is still the duly-elected and sitting governor ~ and that the IL constitution does permit a sitting governor to appoint a Senate replacement ~ but Durbin also said that the US Constitution allows the Senate to determine "acceptable qualifications" of any elected or appointed Senator ~ so the beat goes on ~
