Avoid poorly written legislation and much of the problem ceases to exist.

Before long we will be hearing the right wing complaining about "activist juries."   However, the authorities do make a good point.  If juries can find accused "not guilty" in the face of what they call "unjust laws", couldn't they just as easily find people guilty despite the law and evidence?  It seems to me the legends of white juries finding blacks guilty of crimes regardless of the evidence would support the potential of that practice.

I don't know what it's like in the States and it's too early in the morning to go searching, but up here the Crown as well as the defendant can appeal the outcome of a trial to a higher court.  That takes the case out of the realm of juries and into the rarefied atmosphere of "The Law."
