McConnell Mailers Imply Ky. Voters Are Involved In 'Election Violation' (PHOTOS)

In a move that Democrats are lambasting as a voter suppression tactic, Sen. Mitch McConnell's campaign and its GOP allies are distributing a mailer to Kentucky voters with the title "ELECTION VIOLATION NOTICE."

It warns of "a possible fraud" and reads, "You are at risk of acting on fraudulent information." It says it's paid for by the Republican Party of Kentucky and authorized by the McConnell Senate Committee '14.

The mailer is ultimately a rather creative attack on Democrat Alison Lundergan Grimes, telling the voter that she is feeding them "fraudulent information" and "blatant lies solely to deceive Kentucky voters" about McConnell and her own candidacy.

The mailer surfaced just four days before Election Day, when the Senate GOP leader is polling narrowly ahead of Grimes in an unexpectedly close contest. It's unclear how widely it was sent.

Kentucky Democrats torched the "despicable mailers" as potentially illegal "voter suppression."

"After trying for 16 months to buy this election, Mitch McConnell and the out-of-state special interests that support him are now trying to steal Kentucky’s Senate seat using questionable and possibly illegal voter suppression tactics. The despicable mailers targeting Kentucky voters with misleading information are just another sign of Mitch McConnell's desperation as Kentuckians hold him accountable for his 30-year failed record in Washington," Kentucky Democratic Party Chair Dan Logsdon said in a statement.

Spokespersons for the Kentucky Republican Party and the McConnell campaign did not respond to several requests for comment on Friday.

McConnell is a sssssnake ~ while I'm pleased Alison Lundergan Grimes responded to this, I'm not sure what effect [if any] the lawsuit will have on the election given the timing ~ :g ~ Sooz

Grimes Sues McConnell Over 'Despicable' Voter Mailers

The campaign of Kentucky Democrat Alison Lundergan Grimes has filed a lawsuit to stop Republican Sen. Mitch McConnell's campaign from distributing a mailer that it says amounts to illegal voter intimidation tactics.

The Grimes campaign on Friday said it had filed for an immediate injunction with the state court in Franklin County, which is where the state capital is located.

The campaign is calling for a state and federal investigation of the mailers that say they're authorized by the Kentucky Republican Party and the McConnell Senate campaign. The legal filing by the Grimes campaign can be read below, first reported by TPM.

"Of all the terrible things Mitch McConnell has done during this 30 year career in Washington, this last-ditch campaign he authorized to intimidate Kentuckians and prevent them from exercising their right to vote is unquestionably his most despicable," Grimes campaign manager Jonathan Hurst said.

The mailers have the words "ELECTION VIOLATION NOTICE" sprawled at the top and attack Grimes for spreading "fraudulent" information.

The McConnell campaign and the Kentucky Republican Party have not returned queries from TPM regarding the mailers.

No big surprise [INcluding that McConnell "... stood by the mailers on the campaign trail during the weekend, calling them "entirely factually accurate ..."] ... but still a disappointment ~ :g ~ Sooz

Judge Denies Grimes Lawsuit Over McConnell 'Election Violation' Mailer

A Kentucky judge on Monday rejected a court motion filed by Democrat Alison Lundergan Grimes seeking an immediate injunction to stop Republican Sen. Mitch McConnell's campaign from sending out mailers that have the appearance of an official Kentucky notice.

The mailers, reported Friday by TPM, read "ELECTION VIOLATION NOTICE" and go on to warn voters that they may be acting on "fraudulent" information from the Grimes campaign. The tactic ultimately amounts to a creative attack on Grimes, although the mailers could create the impression that the voters who received them are at risk of committing voter fraud if they cast a ballot.

Franklin County Circuit Judge Phillip Shepherd denied the Grimes motion, spokespersons for the Grimes and McConnell campaigns confirmed on Monday.

Grimes is "exploring options" on what to do next, her spokesperson said.

With the hard-fought U.S. Senate election just one day away, it's not clear that how much of an impact the lawsuit, filed Friday, would have had even if Grimes had won an injunction.

Election law expert Rick Hasen was unimpressed with the legal complaint.

"Some people might be confused by the flyer and maybe even think they are accused of some kind of elections code violation. But anyone who reads it will see it is clearly a nasty attack ad aimed at Grimes. Voters are not stupid nor so easily intimidated," he wrote.

McConnell stood by the mailers on the campaign trail during the weekend, calling them "entirely factually accurate," according to Tom Loftus of the Louisville Courier-Journal.

The Grimes campaign had blasted the mailers as a "despicable" attempt at voter suppression.
