According to the United States Supreme Court and, even more recently, the Seventh Circuit Court of Appeals atheism is a religion. There have been a number of other cases where that has been reaffirmed. Depending upon whose ox is getting gored, sometimes atheists like the definition and sometimes they don't. In short they are morally wishy washy on the subject.
