Hershey sued for $5 million over Reese’s ‘misleading’ candy packaging

A Tampa woman is suing Hershey for “false and deceptive advertising” when it comes to Reese’s Peanut Butter products.

Cynthia Kelly of Tampa Bay filed a class action lawsuit in Florida’s Middle District Court against the candy company for $5 million.

According to the Washington Post, Kelly alleged that Reese’s products were meant to have “explicit carved out artistic designs,” but she found “no such carvings in the actual products.”

The complaint said Kelly found the product at an Aldi in Hillsborough County, Florida. She purchased the Reese’s Peanut Butter Pumpkins for $4.49. But she said that no design was on the chocolate.

On the packaging of the Reese’s Pumpkin, a jack-o’-lantern design is featured, but the chocolate had a blank face.

Todd Scott, a spokesperson for Hershey, told The Washington Post that the company does not comment on pending litigation.

“Hershey’s labels for the products are materially misleading and numerous consumers have been tricked and misled by the pictures on the products’ packaging,” the complaint read.
